Fees and Services

Registration and posting with PCBIDZ is free to purchasers and sellers alike. Posting of any item, description, pictures is entirely free.
PCBIDZ fee for services is 0% of the FINAL sale price of any item posted, whether single or multiple of same or variety of articles. By posting an item, the user agrees to honestly depict the item with the picture and or physical description. PCBIDZ accepts no liability should the item purchased not be same to description posted. PCBIDZ reserves the right to: pull item postings, memberships etc. should item depictions not be accurate.

Changes to the policy are effective after we provide you with at least fourteen (14) days' notice of the changes by posting the changes on the Site. However, we may choose to temporarily change our Fees and Credits Policy and the fees for our services for posting and or purchasing (bidding). We may change our Fees and Promotional events (for example, free purchasing days) and such changes are effective when we post the temporary promotional event on the Site. We may in our sole discretion change some or all of our services at any time. In the event we introduce a new service, the fees for that service are effective at the launch of the service. Unless otherwise stated, all fees are quoted in Canadian Dollars. You are responsible for paying all fees associated with using our service and our website and all applicable taxes. By registering for posting any sale items, you automatically agree to adhere and uphold PCBIDZ terms and conditions, and agree to pay the fees described.

Fees are payable regardless of purchase being a fixed sale or auction, sale price being lower/higher than anticipated, purchaser refuses to pay final price for any reason. Once the item is posted as sold, the fees are due and payable. If the fee is not paid, against policy and agreement undertaken, PCBIDZ reserves the right to take appropriate action depending on scope, including but not limited to: suspension of account, seizure of sale items, account put into collection.

Please note that certain taxes and government charges may be payable in relation to any purchase transaction. We accept no responsibility for such taxes and other government charges on transactions on the Site.

By using PCBIDZ Inc. (other than to read this Agreement for the first time), user agrees to comply with all of the terms and conditions. PCBIDZ Inc allows only one account per registered member. The right to use an account is personal to the user and is not transferable to any other person. The user is responsible for all use of their Account (under any screen name or password) and for ensuring that all use of the Account complies fully with the provisions of this Agreement. PCBIDZ accepts no responsibility to protect the user`s password outside of our own secure system. This is at the discretion of the user to keep their information confidential. PCBIDZ does NOT share any personal information with any other person, business or entity.

Bidding and Buying

As a buyer, you are obligated to complete the transaction with the seller: (i) if you purchased the item through one of our fixed price formats; or (ii) if you are the highest bidder at the end of an auction (meeting the applicable minimum bid or reserve requirements) and your bid is accepted by the seller, unless the transaction is prohibited by law or by this Agreement. By bidding on an item you agree to be bound by the conditions of sale included in the item's description by the seller so long as those conditions of sale are not in violation of this Agreement or otherwise unlawful. Bids are not retractable except in exceptional circumstances such as when the seller materially changes the item's description after you bid, a clear typographical error is made, or you cannot authenticate the seller's identity. If you choose to bid on adult items, you are certifying that you have the legal right to purchase such items.

Fixed Price Marketplace.

We also offer you the availability to purchase items at a fixed price from PCBIDZ Inc with our buyout program.

Binding Bids

If you receive at least one bid at or above your stated minimum price (or in the case of reserve auctions, at or above the reserve price), you are obligated to complete the transaction with the highest bidder upon the auction's completion, unless there is an exceptional circumstance, such as: (a) the buyer fails to meet the terms of your listing (such as payment method), or (b) you cannot authenticate the buyer's identity.

General

This Agreement shall be governed in all respects by the laws of the Province of Ontario and Quebec and the federal laws of Canada applicable therein. We do not guarantee continuous, uninterrupted or secure access to our services, and operation of our Site may be interfered with by numerous factors outside of our control. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. You agree that this Agreement and all incorporated terms and conditions may be automatically assigned. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.

Contracts in English

It is the express wish of the parties that this document and any related documents be drawn up and executed in English. Les parties aux présentes ont expressément demandé que ce document et tous les documents s'y rattachant soient rédigés et signés en anglais.

Disclosures

The services hereunder are offered by PCBIDZ Inc. Fees for our services are described as above. Parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist you in limiting access to material that is harmful to minors including but not limited to PCBIDZ Adult section. This content is inappropriate for minors. However we are not responsible if any minor accepts our terms and conditions, though clearly stipulated they are to be above legal age. Disputes

Regarding any disputes about our Site it may be reported to us be emailing us at customer service at info@pcbidz.com. We encourage you to report all user-to-user disputes to your local law enforcement, postmaster general or a certified mediation or arbitration entity.

Warranty/Theft

PCBIDZ does in anyway agree to or provide any item sold warranty access made outside of PCBIDZ or from seller to buyer unless the item was purchased directly from PCBIDZ.

PCBIDZ Holds no liability should an item be stolen, lost or damaged. PCBIDZ Inc will assist you in taking proper actions through available channels and or through local authorities should any of these situations arise.

Indemnity

You agree to indemnify and hold us and our parent, subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.

Legal Compliance

You shall comply with all applicable laws, statutes, ordinances and regulations regarding your use of our service and your bidding on, listing, purchase, solicitation of offers to purchase, and sale of items.

PCBIDZ Inc contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound, and the entire contents of PCBIDZ Inc are copyrighted as a collective work under Canadian copyright laws. No part mentioned may be modified, published, transmitted, and user may not participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of PCBIDZ Inc and the copyright owner. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. The user acknowledges that it does not acquire any ownership rights by downloading copyrighted material.

Subscriber shall not upload, post or otherwise make available on PCBIDZ Inc any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright. They shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By posting items and or description on the public forum of PCBIDZ Inc the user automatically grants, or warrants that the owner of such material has expressly granted PCBIDZ Inc the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. By posting items and or text, the user also grants other users to access, view, store or reproduce the material for that personal use. The user does hereby grant PCBIDZ Inc the right to edit, copy, publish and distribute any material made available on PCBIDZ Inc.

Shill bidding is prohibited on the site, that is the placing of bids or causing bids to be placed on any product for the purpose of artificially increasing or otherwise manipulating the bidding process on PCBIDZ.com or the bid price of any product listed on the site, or influencing user behavior. This will result in, but not necessarily be limited to: termination of account, privileges, account collections or seizures.
